Hello दोस्तों तो कैसे है आप आज हम बात करेंगे लड़ाई झगड़ा करने से हमें कौन कौन सी धरा ऐ लग सकती है।मनुष्य संसार का बेस्ट क्रिएशन है। फिर भी मनुष्य अपनी हरकतों से बाज़ नहीं आता। जब भी देखो हर वक्त कोई न कोई मनुष्य किसी न किसी के साथ लड़ाई झगड़ा करते पाया जाता है। कभी कभी तो लड़ाई इतनी हद तक बढ़ जाती है के जान पे बन आती है। लड़ाई करते वक्त उसे होश नहीं रहता के पुलिस प्रशाशन IPC की धारा ऐ उसका थाने पे इंतज़ार कर रही है। जब उसे होश आता है तो वो सलाखों के पीछे अपने आप को पाता है।
भारतीय दंड संहिता यानि IPC ACT अंग्रेजो ने हमें भेट में दी थी जो हमें 1862 में ब्रिटिश काल में मिला था। उसके बाद भारत के आज़ाद होने पर समय समय पर इसमें बदलाव किया गया।तो फिर आज हम बात करते है ,के लड़ाई झगड़ा या मारपीट करने से हमें कौन कौन सी धरा ऐ लागू होती है और हमें कौन कौन सी सजा ऐ मिलती है।

IPC 307 की धारा।
भारतीय दंड संहिता 307 के अनुसार लड़ाई झगड़े के दौरान अगर कोई शख्श किसी की हत्या करने के आशय से मारपीट करे और वह शख्श बच जाये या वह हत्या करने में नाकाम रहता है , तब गुन्हेगार शख्श के ऊपर ये धारा लागू होती है। उसपे धारा 307 के आधीन मुकद्दमा चलता है।
सजा
आम तौर पर आरोपी के ऊपर 10 साल की सजा और जुर्माना हो सकता है।लड़ाई झगड़े के दौरान जिस आदमी की हत्या करने की कोशिश की गयी हो और उसे गंभी चोटे आयी हो तो आरोपी को उम्र कैद की सजा भी हो सकती है। लेकिन ये दंड भारतीय सेना पर लागु नहीं होता।
IPC 308 की धारा।
भारतीय दंड संहिता 308 के अनुसार लड़ाई झगड़े के दौरान अगर कोई शख्श किसी की हत्या करने के आशय से मारपीट करे पर उसका इरादा हत्या करने का न हो पर दूसरे शख्श को गंभीर चोंटे लग जाऐ तब उस पर धारा 308 के आधीन मुकद्दमा चलता है।
सजा
आम तौर पर आरोपी के ऊपर 3 साल की सजा और जुर्माना हो सकता है।लड़ाई झगड़े के दौरान जिस आदमी की हत्या करने की कोशिश की गयी हो और उसे गंभी चोटे आयी हो तो आरोपी को 7 साल की सजा भी हो सकती है या फिर आर्थिक दंड या दोनों। ये एक गैर जमानती आरोप है।
IPC 323 की धारा।
भारतीय दंड संहिता 323 के अनुसार लड़ाई झगड़े के दौरान अगर कोई शख्श को जान बुज कर किसी को चोट पहुंचाता है या थप्पड़ मारता है | तब उस पर धारा 323 लागु होता है |
सजा
आम तौर पर आरोपी के ऊपर 1 साल की सजा और 1000 रूपया जुर्माना हो सकता है। ये एक ज़मानती अपराध है |
IPC 324 की धारा।
भारतीय दंड संहिता 324 के अनुसार लड़ाई झगड़े के दौरान अगर कोई शख्श किसी को गोली चलाने या काटने से गंभीर चोंटे पहोंचाये या आग के माध्यम से या फिर कोई गरम पदार्थ या कोई विषैला पदार्थ से जिन का स्वास लेने में तकलीफ हो या रक्त में प्रवेश कराया जाये तब उस पर धारा 324 के आधीन मुकद्दमा चलता है।
सजा
आम तौर पर आरोपी के ऊपर 3 साल की सजा और जुर्माना हो सकता है। ये एक गैर ज़मानती अपराध है |
IPC 325 की धारा।
भारतीय दंड संहिता 325 के अनुसार लड़ाई झगड़े के दौरान अगर कोई शख्श किसी को गंभीर चोट पहुंचाए किसी को चाकू से वार करे , एसा ज़ख्म दे जेसे जान का खतरा हो या फिर शारीर का कोई अंग काट दे तब उस पर धारा 325 के आधीन मुकद्दमा चलता है।
सजा
आम तौर पर आरोपी के ऊपर 7 साल की सजा और जुर्माना हो सकता है। ये एक ज़मानती अपराध है | इसमें समझौता हो सकता है |
IPC 326 की धारा।
भारतीय दंड संहिता 326 के अनुसार लड़ाई झगड़े के दौरान अगर कोई शख्श किसी की शारीर की हड्डिया तोड़ दे उसे पथारी वश करदे तब उस पर धारा 326 के आधीन मुकद्दमा चलता है।
सजा
आम तौर पर आरोपी के ऊपर 10 साल की सजा या फिर आजीवन कारावास और जुर्माना हो सकता है। ये एक गौर ज़मानती अपराध है |
सोचिये अगर हम किसी सरकारी कचेरी में जा के लड़ाई झगडा या हंगामा या मारपीट करे तब हम पर कोन सी धारा लागु होगी और हमें सजा क्या मिलेगी ?
IPC 352 की धारा।
भारतीय दंड संहिता 352 के अनुसार अगर कोई शख्श किसी सरकारी काम काज में कोई अड़चन रूप साबित हो तब उस पर धारा 352 के आधीन मुकद्दमा चलता है।
सजा
आरोपी के ऊपर 2 साल की कारावास की सजा मिलती है |
IPC 504 की धारा।
भारतीय दंड संहिता 504 के अनुसार अगर कोई शख्श किसी सरकारी कर्मचारी से गाली गलोच करे या लड़ाई झगडा तब उस पर धारा 504 के आधीन मुकद्दमा चलता है।
सजा
आरोपी के ऊपर 2 साल की कारावास की सजा मिलती है |
IPC 506 की धारा।
भारतीय दंड संहिता 506 के अनुसार अगर कोई शख्श किसी सरकारी कर्मचारी जान से मारने की धमकी दे तब उस पर धारा 506 के आधीन मुकद्दमा चलता है।
सजा
आरोपी के ऊपर 3 से 7 साल की कारावास की सजा मिलती है |
IPC 332, 333 की धारा।
भारतीय दंड संहिता 332 , 333 के अनुसार अगर कोई शख्श किसी सरकारी कर्मचारी को गंभीर रूप से चोट पहुंचाए तब उस पर धारा 332 , 333 के आधीन मुकद्दमा चलता है।
सजा
आरोपी के ऊपर 2 से 7 साल की कारावास की सजा मिलती है |
IPC 338, 384, 386 की धारा।
भारतीय दंड संहिता 338, 384, 386 के अनुसार अगर कोई शख्श किसी सरकारी कर्मचारी को गैर कानूनन Blackmail करे तब उस पर धारा 338, 384, 386 के आधीन मुकद्दमा चलता है।
सजा
आरोपी के ऊपर 2 से 10 साल की कारावास की सजा मिलती है |
IPC 427 की धारा।
भारतीय दंड संहिता 427 के अनुसार अगर कोई शख्श किसी सरकारी कचेरी में जबरदस्ती घुस जाये तब उस पर धारा 427 के आधीन मुकद्दमा चलता है।
सजा
आरोपी के ऊपर 2 साल की कारावास की सजा मिलती है |
IPC 378,379 की धारा।
भारतीय दंड संहिता 378, 379 के अनुसार अगर कोई शख्श किसी सरकारी कचेरी के माल सामान को नुकशान पहोंचाता है या फिर सरकारी दस्तावेजो के चोरी करे | तब उस पर धारा 378, 379 के आधीन मुकद्दमा चलता है।
सजा
आरोपी के ऊपर 3 साल की कारावास की सजा मिलती है |
IPC 141,143 की धारा।
भारतीय दंड संहिता 141 , 143 के अनुसार अगर कोई शख्श किसी सरकारी कचेरी में गैर वैधानिक भीड़ इकटठी करे शोरो शराबा करे | तब उस पर धारा 378, 379 के आधीन मुकद्दमा चलता है।
सजा
आरोपी के ऊपर 3 साल की कारावास की सजा मिलती है |
